How to use it

  1. Enter hours worked each day of your workweek (day 1 is the first day of your employer's workweek).

The formula

Each day: first 8 hours regular, hours 8–12 at 1.5×, hours over 12 at 2×

7th consecutive day worked in the workweek: first 8 hours at 1.5×, over 8 at 2×

Week: regular hours beyond 40 become 1.5× (hours already counted as daily overtime aren't counted twice)

Example: Four 10-hour days: each has 8 regular and 2 overtime hours, so 32 regular and 8 overtime. Under federal rules alone, 40 hours would have no overtime at all.

Good to know

  • California's minimum wage is $16.90 an hour in 2026; many cities set higher local minimums.
  • An approved alternative workweek (such as 4/10s) can change when daily overtime starts.
  • Meal periods are required after 5 hours of work; missed meal or rest breaks earn one extra hour of pay each day.

Questions

Does California pay overtime after 8 hours?

Yes. Non-exempt employees get 1.5 times their regular rate for hours over 8 in a workday and double time for hours over 12.

What is the 7th day rule in California?

If you work all seven days of a workweek, the first 8 hours on the seventh day are paid at 1.5× and anything over 8 at 2×.

Can I get daily and weekly overtime for the same hours?

No. Hours paid as daily overtime don't count again toward the 40-hour weekly total. The calculator applies this automatically.

Are salaried workers in California exempt?

Only if they meet the duties test and earn at least twice the state minimum wage for full-time work: $70,304 a year in 2026.
